On behalf of the Chinese student community, I am reporting that a user (ID: xxx) on the NightCafe Studio platform has posted AI-generated content that maliciously exploits AI technology to fabricate and disseminate infringing images impersonating Chinese leaders. This is a blatant violation of Section 3(d).4 of your platform's Terms of Service regarding the unauthorized use of copyrighted content and Section 3(d).5 regarding content that infringes or violates the rights of others. Furthermore, Section 3(e).3 states that the user infringes, misappropriates, or violates a third party's intellectual property rights, right of publicity, or right of privacy.(original text:3.User Content, Prohibited Conduct and Community Standards D.Prohibited Content means material comments, interactions, images or User Content which is considered to include the following:4.content subject to copyright that is used without the express permission of the owner of the content 5.content that violates or encroaches on the rights of others, including but not limited to Intellectual Property Rights or privacy rights;E.You agree that you are solely responsible for all User Content that you make available on or through the Site, including on social media using a Tag. You represent and warrant that:3.neither the User Content nor the posting, uploading, publication, submission or transmission of the User Content or our use of the User Content on, through or by means of our Site (including on social media) will infringe, misappropriate or violate a third party's Intellectual Property Rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation (for the avoidance of doubt, this includes where using the Model Fine Tuning feature to submit User Content that includes a natural person residing in the state of Illinois, United States of America).
Therefore, this work misappropriates the image and social identity of Chinese leaders without authorization, generates named and insulting images through AI model fine-tuning, intentionally confuses public perception, and uses the identities of Chinese leaders in derogatory contexts without permission, directly infringing the rights and interests of Chinese leaders.
On behalf of the overseas Chinese student community, I urge your platform to immediately remove the infringing work and freeze the publisher's account. Otherwise, we reserve the right to work with our legal team to file a copyright infringement lawsuit in the Northern District of California.
